FabWise, LLC (we, us, our, or Company), a Georgia limited liability company with its mailing address at 990 Peachtree Industrial Blvd Unit #1233, Suwanee, GA 30024, operates the timeclock software service (the Service), including our website at fabwise.app and any associated mobile applications or features.

We respect your privacy and are committed to protecting personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you or your organization uses the Service.

Important Note for Our Customers (Employers/Businesses): We act as a data processor (or service provider) on behalf of our customers (Customers or you as the business entity subscribing to the Service). Customers are the data controllers responsible for employee personal information processed through the Service. We process employee data only per the Customer's instructions, our Terms of Service, and this Policy.

If you are an employee or end-user whose employer uses our Service, please contact your employer directly with privacy questions.

1. Territorial Restriction

The Service is intended solely for use within the United States of America. We do not knowingly offer or support the Service outside the U.S. Any access or use from outside the United States is strictly prohibited.

2. Information We Collect

A. Information Provided by Customers

• Account and billing information (company name, contact person name, email, phone, billing details).
• Configuration settings, custom fields, or integrations.

B. Employee / End-User Personal Information Processed on Behalf of Customers

• Identification and contact data: name, employee ID, email, phone, department, supervisor, title, employee type, start date, termination date, hourly rate, employment status.
• Time and attendance data: clock-in/out times, shifts, breaks, hours worked, vacation, personal time, holidays.
• Location data: GPS/geofence data (if feature enabled), IP address, device location approximations.
• Device and usage data: device type, OS, browser, app version, login timestamps.

C. Automatically Collected Information

Log data, cookies, and analytics data via Google Analytics 4 (GA4) for traffic-pattern measurement on our marketing site.

We do not sell personal information.

3. How We Use Information

We use information to provide, maintain, improve, and secure the Service, manage accounts and billing (including through Stripe), communicate with Customers, detect fraud/abuse, and comply with legal obligations. We process employee data only as instructed by the Customer and never for our own independent marketing purposes.

4. How We Share Information

We share information only as necessary:

• With service providers/sub-processors (e.g., Stripe for payments, cloud hosting like AWS, Google Analytics 4 for marketing-site traffic measurement) under strict confidentiality and security obligations. Our full subprocessor list is maintained at https://fabwise.app/trust/subprocessors.
• With the Customer's authorized personnel.
• To comply with law, subpoenas, or protect rights/safety.
• In connection with a business transfer (merger, acquisition, etc.).

We do not share employee personal information with third parties for their marketing purposes.

5. Data Retention

We retain data according to the following lifecycle:

• Trial accounts that do not convert: retained 90 days post-trial-end, then deleted.
• Active customer accounts: retained for the duration of the subscription.
• Canceled customer accounts: retained 30 days post-cancellation for reactivation, then deleted.
• Audit log data: retained per applicable regulatory minimums (FLSA: 3 years for hours-worked records).

Upon termination or Customer request, we will delete or return Customer Data per our Terms of Service, subject to backups and legal holds.

6. Security

We implement and maintain commercially reasonable administrative, technical, and physical safeguards to protect information (e.g., encryption in transit and at rest, access controls, regular audits). However, no security measures are infallible. We cannot guarantee absolute security.

7. International Transfers

Because the Service is restricted to use within the United States only, we do not actively support or transfer data outside the U.S. Any incidental international access is prohibited under our Terms of Service.

8. Children's Privacy

The Service is not directed to children under 16. We do not knowingly collect data from children. No user shall allow a minor to use this software.

9. Your Privacy Rights

As a data processor, we assist Customers in fulfilling data subject rights requests under applicable U.S. state privacy laws. If you are an employee or end-user, submit requests via your employer; if you are a Customer or visitor, contact us at privacy@fabwise.app.

CCPA / CPRA rights (California residents)

You have the following rights regarding your personal information:

• Right to Know what personal information is collected, used, shared, or sold
• Right to Delete personal information held about you
• Right to Correct inaccurate personal information
• Right to Non-Discrimination for exercising privacy rights

To exercise these rights, contact privacy@fabwise.app (or via your employer if you are an end-user whose employer subscribes to FabWise).

Multi-state coverage

If you reside in a state with applicable privacy laws (CCPA / CPRA in California, VCDPA in Virginia, CPA in Colorado, CTDPA in Connecticut, UCPA in Utah, or similar), you may have additional rights regarding your personal information. Contact privacy@fabwise.app to exercise those rights.

10. Changes to This Policy

We may update this Privacy Policy at any time. Changes will be posted on our website with a new Last Updated date. Your continued use of the Service after changes constitutes acceptance of the updated Policy.
